In a recent poll posted to X (formerly Twitter), the team at Washington Gun Law asked a simple but powerful question: What do you believe is the single biggest legal threat to your right to keep and bear arms? According to William Kirk, president of Washington Gun Law and host of its popular YouTube channel, over 7,100 people took part in the survey, and the answers paint a clear picture of where gun owners feel the danger lies.
While the political climate always hovers over Second Amendment debates, Kirk deliberately narrowed the focus to laws, not ideologies. “We know the civilian disarmament movement is political,” he said in his video titled The Biggest Threat to Our Gun Rights, According to You. “But let’s focus on the stuff that’s already on the books – or being pushed.”
The Top Threat: Weapon and Magazine Bans

The leading concern among survey participants was weapon and magazine bans, which received 47.3% of the vote. Kirk explained this result in detail, saying that recent judicial rulings have only intensified the anxiety around these laws. In particular, he referenced the Washington State Supreme Court’s decision to uphold a magazine ban as well as the state of Illinois’ defense of its Protect Illinois Communities Act, which includes an assault weapons ban.
Kirk warned that these rulings signal a shift in how courts may define what’s “in common use for self-defense” – a key standard used in District of Columbia v. Heller and reaffirmed in New York State Rifle & Pistol Association v. Bruen. “If the courts accept that only certain firearms are ‘appropriate’ for self-defense,” he said, “then what’s stopping the government from deciding that no firearm is appropriate?”
Pre-Purchase Licensing: A Close Second

Coming in second place was pre-purchase licensing, which earned 34.7% of the vote. Kirk originally believed this would be the number-one threat. “At the time I created the survey, I would’ve voted for licensing,” he admitted. “It gives the government a foot in the door to make lawful gun ownership so expensive and complicated that people just give up.”
One user, known online as “2A Vet,” commented that licensing laws are “manipulated to make it so difficult that people just give up and never get to exercise their rights in the first place.” Kirk echoed this concern, emphasizing how licensing systems can evolve slowly over time into full-blown barriers to access. “The state controls the permission slip,” he said. “And when that happens, your rights are no longer rights – they’re privileges.”
Red Flag Laws Raise Due Process Alarms

Although red flag laws only received 13.2% of the vote, they were not without serious concern. One participant, Blackthorn Digital Forensics, argued these laws are the most dangerous precisely because of their lack of due process. Kirk highlighted this perspective with agreement.
“Red flag laws allow the government to seize firearms without the gun owner ever being charged, let alone convicted, of a crime,” Kirk explained. “And as we’ve seen in multiple cases, they’re ripe for abuse by disgruntled family members, neighbors, or even co-workers.” The chilling part? These laws are already in place in over 20 states.
The “Other” Category: Distrust in Lawmakers

Just under 5% of participants selected “Other,” but their reasoning stood out. Many respondents said the real threat isn’t the laws themselves, but the lawmakers and enforcers who write and uphold them, often in defiance of the Constitution. One commenter, Rob and Avis Ramble, put it bluntly: “The biggest threat is the people who create and enforce the laws that seemingly don’t care about or understand the Constitution.”
This sentiment was echoed by another respondent named Frost Talk IRL, who wrote that the true danger is “politicians merely attempting to pass novel, unconstitutional gun legislation when they know that it’s unconstitutional. It’s sedition.” Kirk didn’t disagree. “You’re absolutely right,” he said. “None of these laws get on the books without someone willing to abuse their office.”
Kirk’s Change of Heart on the Top Threat

While he initially leaned toward licensing as the gravest danger, Kirk admitted that recent court decisions swayed his opinion. “After what I’ve seen in Washington and Illinois,” he said, “I’ve got to agree with the majority of you. Magazine and weapon bans are the number-one legal threat to our rights right now, today.”
What changed his mind? The way courts are reinterpreting the Second Amendment. Rather than following Bruen’s text-and-history standard, some courts are drifting toward a “balancing test” where judges get to weigh the government’s goals against your individual rights. “That’s a dangerous road,” Kirk said. “Because once the courts start balancing your rights away, where does it stop?”
Why the Courts Matter So Much

One of the most striking parts of Kirk’s analysis is how much weight he places on state courts and their interpretations of federal rulings. Many gun rights advocates tend to focus on federal legislation, but Kirk’s video is a reminder that the front lines of the Second Amendment fight are increasingly local.
His warning is clear: “Just because the Supreme Court ruled in Bruen doesn’t mean every judge is going to follow it.” That’s why states like Washington and Illinois can pass laws that directly contradict federal precedent and still have them upheld, for now. “We’re watching the erosion happen,” Kirk said, “in real time.”
Licensing Laws Are Silent Killers

Another fascinating takeaway from the video is how licensing laws operate under the radar. Unlike flashy assault weapon bans or viral red flag cases, licensing is a slow squeeze. It doesn’t generate headlines, but it chips away at access bit by bit.
Kirk’s point about “chronologically and financially impossible” access is particularly important. It’s not just the upfront cost of a license – it’s the background checks, training requirements, waiting periods, and bureaucratic hurdles that price out low-income Americans, even though their need for self-defense may be greater than most.
The Survey Itself Was a Call to Action

What made this survey different from other polls was the community-driven nature of it. Kirk regularly invites his audience to leave comments and share ideas, but this time he let them lead the conversation. “You guys are fantastic about participating,” he said. “This was your voice, not mine.”
Over 7,000 people voting, hundreds leaving comments – this wasn’t just a casual question. It was a snapshot of what law-abiding gun owners fear most in May 2025. And those fears aren’t abstract – they’re tied to actual laws already in effect.
A Warning for the Future

Kirk closed the video with a clear message: be alert. “Government doesn’t always take your rights in one big sweep,” he said. “They wear you down over time – regulation by regulation, court ruling by court ruling.” The key, he added, is to stay informed and fight back through legal education and civic engagement.
It’s advice well worth repeating. Whether the threat comes from licensing, bans, or due process violations, the danger is cumulative. Small laws today become major barriers tomorrow. And as Kirk put it, “You can’t be a lawful and responsible gun owner if you don’t know the law.”

What this survey shows is that gun owners are paying attention – and they’re not fooled by vague promises or “common sense” buzzwords. Whether it’s magazine bans upheld by questionable rulings or licensing rules designed to frustrate, the Second Amendment community is keenly aware of the pressures closing in.
