How They’ll Ban Handgun Sales Without a Vote

In a recent report, Washington Gun Law, attorney William Kirk detailed a plan already underway in California that he says could eventually end handgun sales – without lawmakers ever having to vote for an outright ban. According to Kirk, the key tool behind this effort is something called “microstamping,” a technology that marks each fired cartridge with a unique identifying code from the gun’s firing pin.

Kirk explained that California Senate Bill 452, signed into law in 2023, sets up the requirement. The system relies on laser-engraved firing pins that leave a microscopic code on every spent cartridge case. Law enforcement could then trace that code back to a specific firearm. At first glance, this might sound like a crime-fighting breakthrough, but Kirk warned viewers that the impact goes far beyond forensic science.

According to Kirk, the law required California’s Department of Justice to study whether microstamping technology was viable. This year, the agency issued an 18-page report concluding that it works and can be used regularly, even after thousands of rounds are fired. Kirk was not surprised at this result. “Who didn’t see that coming?” he asked, pointing out that most of the studies the DOJ relied on came from companies that stand to profit from selling microstamping components.

A Timeline That Could Change Everything

Kirk carefully outlined the timeline that follows the DOJ’s findings. By September 2025, the state must finalize performance standards for companies making microstamping parts. By January 2026, those companies can start applying for licenses to produce the parts. By mid-2026, the state will begin signing contracts with them. Then, on January 1, 2028, only pistols equipped with these components will be allowed to be sold in California.

In Kirk’s view, this is where the trap is set. He argued that the cost and complexity of retrofitting every pistol model with unique microstamping components will make it unprofitable for most manufacturers. “You are not going to go through the expense of producing unique firing pins just for one state,” he said. That means most manufacturers will simply stop selling pistols there, leaving very few models available.

Monopolies and High Prices

William Kirk went on to explain that the few companies willing to play along could be handed monopolies. California would have full control over which brands and models get approved, effectively picking winners and losers in the market. Kirk warned that costs will skyrocket as a result, turning gun ownership into something only the wealthy can afford.

A Strategy That Spreads

The most troubling part, according to Kirk, is how these types of laws spread. “Bad and crazy gun laws are like untreated cancer,” he said. “They metastasize and go wherever they can.” Once California creates a system like this, other states with strong gun control agendas, he calls them the “dirty dozen,” could adopt the same model. Without a single vote to outlaw handguns, the effect could be a nationwide reduction in sales.

It’s easy to see why some politicians like this approach. It avoids the headlines of passing a handgun ban while producing the same result over time. Kirk described it as a slow, procedural squeeze: “They have absolutely thwarted any reasonable opportunity you have to arm yourself with a handgun.”

Why This Plan Is So Effective

What makes this entire scheme fascinating is how invisible it is to most people. There is no dramatic moment where a legislature votes to ban handguns. Instead, it’s a bureaucratic process: reports, standards, deadlines, and licensing rules. This sort of slow-motion restriction is much harder to rally public opposition against because the change feels technical, not political. By the time people realize what has happened, the market has already dried up.

Could Manufacturers Fight Back?

One thing that stands out in Kirk’s breakdown is the question of how manufacturers will react. It seems possible that some might try to adapt, but his point about cost is persuasive. Adding a unique firing pin to every single handgun line, just for California, may not make business sense. And if companies do comply, it raises a second question: what happens when the same requirement pops up in other states? Suddenly, the entire industry is producing guns to a standard that lawmakers can keep tightening.

Kirk’s explanation is a reminder of how fragile rights can become when they’re choked by process rather than direct prohibition. This plan, if it unfolds as California intends, will eventually mean there are almost no new handguns available for sale in the state by 2028. Without a ban, they’ve created a barrier so high that the result is almost the same as outlawing them.

William Kirk’s warning, delivered on Washington Gun Law, is straightforward: watch California. These changes will affect not just that state but the entire gun market, and they could serve as a blueprint for other states. He urges people to stay informed because, as he says in every video, knowing the law is the only way to protect yourself when the rules are being rewritten.

This report from Kirk is eye-opening because it highlights a new kind of strategy: one that doesn’t need voters, doesn’t need open debate, and doesn’t even look like a ban at first. It’s subtle, slow, and very effective. Whether you agree or disagree with him, it’s hard to deny that the plan he describes in California has the potential to reshape gun ownership in ways the public hasn’t yet grasped.
