Woman Found Asleep in Running SUV Blows One of the Highest BAC Results Officers Had Seen

A woman found asleep behind the wheel of a running SUV in Boca Raton, Florida, was arrested for DUI after officers said she showed clear signs of impairment and later produced breath samples more than four times the legal limit, according to a bodycam footage report from BodyCamZero.

The BodyCamZero narrator said the woman, identified in the footage as Kristen Payne, was found parked in front of a residential home with music blasting while the vehicle was still running. A neighbor called police after the SUV had reportedly been sitting in the roadway for about an hour.

When officers woke her, Payne appeared confused, tired, and unsure of where she was.

“What city do you live in?” one officer asked her.

“Greenacres,” Payne said.

When asked what city she was in at that moment, she answered, “Greenacres?”

The officer corrected her.

“No,” he said. “You’re in the city of Boca.”

A Neighbor Notices The SUV

The call began after a resident noticed the vehicle sitting outside and blocking or sitting near a driveway.

A witness later told police the car had been there for around an hour with music playing. She said she first assumed there was nobody inside, then looked more closely and realized a woman was sleeping in the vehicle.

“There’s a lady in there sleeping,” the witness told officers, explaining that she had been worried it might have been an overdose because she was a nurse.

She said she did not go into the vehicle and instead called for help.

That decision may have prevented a worse outcome. A running vehicle with someone unconscious or asleep behind the wheel can point to a medical emergency, intoxication, or something else entirely, and a bystander trying to handle it alone could easily put themselves at risk.

When officers arrived, they found Payne in the driver’s seat and began trying to figure out whether she needed medical help or was safe to drive.

Officers Try To Wake Her And Sort Out Where She Is

In the footage, an officer approached the SUV and asked Payne what was going on.

“Do you need medical help?” the officer asked.

“No,” Payne replied.

The officer asked what she was doing, and she said she was sleeping.

Unfortunately, the officer explained, she was parked in front of residential houses, and police needed to know whether she could move the vehicle safely.

“Are you good to drive?” the officer asked.

At first, Payne said she had just woken up. When asked where she had come from, she said a friend’s house, then later said she did not have friends.

“Friends,” she said at one point.

“I don’t have friends,” she said moments later.

That contradiction was one of several early signs that officers were dealing with someone who was not fully oriented.

Another officer asked whether she knew where she was. Payne answered, “Riviera,” even though officers had already explained she was in Boca Raton.

Confusion Raises Concern

Officers tried to learn where Payne lived and where she was trying to go, but her answers shifted.

She said she wanted to go home, then said she was going to her sister-in-law’s house. When asked whether she knew the person whose driveway she had blocked, she first suggested she did, then admitted she did not.

“I actually don’t know the person,” Payne said.

Officers told her they were concerned for her safety and the safety of everyone else on the road. Before allowing her to drive away, they said they needed to determine whether she was impaired.

“My concern is that I want to make sure you get home safe,” one officer told her.

That is the core of most DUI investigations. Officers are not only looking at whether someone drove badly in front of them. They are also looking at whether the person was in actual physical control of a running vehicle and whether letting them drive away would put others in danger.

Here, the car was running, Payne was in the driver’s seat, and she appeared unable to explain clearly where she was or where she had come from.

Field Sobriety Exercises Go Poorly

Officers asked Payne to perform field sobriety exercises to help them determine whether she was impaired.

During the walk-and-turn instructions, one officer told her to put her left foot on the line.

She put down her right foot instead.

“That’s your right foot,” the officer said.

The officer then asked whether she knew her left from her right and told her to show her left hand.

“That’s not a hand,” the officer said after Payne apparently pointed to or moved her foot. “That’s a foot.”

The exchange became one of the clearest moments in the footage. Payne struggled not only with balance and instructions, but with basic left-right identification.

The officer reminded her that the exercises were not mandatory, but also explained that refusing to continue could be used in court and that another officer would have to make a decision based on the observations already made.

Payne initially said she did not want to continue, then agreed to keep going.

The officers continued trying to guide her through the exercises, repeating instructions and demonstrating what they wanted her to do.

Officers Decide She Is Impaired

Payne struggled through multiple exercises, including walking heel-to-toe, standing on one leg, touching the tip of her finger to the tip of her nose, and estimating 30 seconds with her eyes closed.

At times, she appeared confused about the instructions and had to be reminded repeatedly to keep her head back, close her eyes, or use the correct hand.

Eventually, an officer told her the decision had been made.

“I have reason to believe that you are impaired,” the officer said.

The officer explained that Payne would have to come with police because they did not believe it was safe for her to drive to any destination.

“I don’t feel it’s safe for you to drive home or drive to whatever destination you’re going to without putting other people at risk,” the officer said.

Payne asked why that was happening, but officers had already gathered enough from the original call, her confusion, the running vehicle, and the exercises.

The arrest was not based on one awkward answer. It was based on the full picture.

Items In The Vehicle Raise More Questions

After Payne was detained, officers searched the vehicle and discussed items found inside.

In the footage, officers mentioned multiple condoms, sex toys, and other personal items. One officer said they would complete a “green sheet,” suggesting they were documenting possible indicators related to sex work, though Payne was not shown being charged with anything related to that in the report.

Officers also found capsules and asked Payne whether she had a prescription for them.

“Kristen, these capsules that you have, do you have a prescription for these?” an officer asked.

Payne said they were prescribed to her and said they were for seizures.

The officer asked whether she had a way to verify the prescription, such as through an app or a paper prescription, and asked why she kept the pills in a container instead of the original bottle.

Payne did not give a clear explanation.

That part of the footage added uncertainty, but the central charge remained DUI. The officers’ main concern was whether Payne had been impaired while in control of the SUV.

Breath Samples Were Extremely High

After the arrest, officers began the DUI testing process and read the required statements before requesting a breath test.

The officer explained that the proceeding was being video recorded and asked Payne to submit to a lawful breath test to determine her alcohol content.

Payne agreed.

According to the BodyCamZero report, her breath samples later registered .335 and .349, more than four times Florida’s .08 legal limit.

Those numbers are extremely high. At that level, many people would be at serious risk of passing out, choking, suffering alcohol poisoning, or being unable to protect themselves from danger.

The video description also said Payne later refused a blood test at the hospital.

This is where the case becomes more alarming than a typical DUI stop. Payne was not simply a driver who had one too many and got pulled over. She was found asleep in a running SUV, unsure of where she was, and later tested at a level that suggested severe intoxication.

A Dangerous Situation That Could Have Ended Worse

The fact that Payne was parked rather than driving at high speed may have prevented a tragedy.

Still, officers treated the situation seriously because a running vehicle can become dangerous the moment someone wakes up and decides to drive away.

A person who does not know what city they are in, cannot clearly say where they came from, and struggles to identify left from right during sobriety testing should not be behind the wheel.

The neighbor’s call likely mattered. Without it, Payne could have woken up, tried to drive home or to another location, and put herself or someone else in danger.

Sometimes DUI enforcement starts with a traffic stop. Other times, it starts with a resident noticing a car that has been sitting too long with the engine running and the music loud.

Arrested For DUI In Boca Raton

The BodyCamZero report said Payne was arrested for DUI after officers concluded she was impaired.

During the formal process, Officer O’Neal confirmed that Payne had been arrested in violation of Florida DUI law and that the incident occurred in Boca Raton, Palm Beach County.

The case is a reminder that DUI does not require a dramatic crash or a high-speed pursuit to become serious.

An idling SUV in a neighborhood, a sleeping driver, and a confused conversation with police were enough to reveal a dangerous situation.

By the time the breath results came back, the concern officers had at the scene appeared to be more than justified.

Payne had been found asleep in a running vehicle outside a home where she did not belong, unable to explain where she was, and later recorded breath samples far above the legal limit.
