A 47-year-old man has been charged with capital murder after a 5-year-old girl was killed and two other children were injured when gunfire struck a vehicle carrying a mother and her five young children in Cypress, Texas.

FOX 26 Houston reporter Olivia Dance said the suspect, Jeremy Porter, was being held in the Harris County Jail after investigators connected him to the shooting, which authorities have described as an apparent road rage incident.

The victim, 5-year-old Zah’Layah Walter, was shot while riding with her mother, Monica Hicks, and four siblings, all of whom were under the age of 10.

Hicks survived the shooting, but her daughter later died at the hospital.

Gunfire Erupted Near the Family’s Home

Dance reported that the shooting happened late Saturday night as Hicks was driving westbound on Grant Road near Jones Road and was close to turning into her home at The Estates at Cypress.

According to Hicks, a white four-door Ford truck pulled alongside her vehicle and someone inside opened fire, sending more than five rounds into the family’s car.

Two of the children suffered minor injuries from shattered glass, while Zah’Layah was struck by gunfire and was later airlifted to Memorial Hermann Hospital, where she died.

Hicks told FOX 26 that she had no interaction with Porter before the shooting began.

That point stands in direct tension with the account contained in court records, which Dance said indicated Porter told investigators he believed a man was driving the other vehicle, thought someone had fired at him, and believed the vehicle was being driven erratically.

Those statements are part of the developing case and have not been tested in court.

Mother Says Her Children Saw Their Sister Die

Hicks described the loss in terms that make the scale of the tragedy hard to overstate.

“The light of my life … she was so loving,” she said.

Hicks said the last thing Zah’Layah told her was, “I love you, mommy,” before giving her a kiss.

“Who knew that would be the last time I’d ever hear my daughter talk?” she said.

The surviving children also witnessed what happened inside the vehicle.

“All of my children were there, and they witnessed their sister lifeless on the floor,” Hicks said. “They are traumatized, and they’re asking questions.”

That is one of the most painful parts of the case, because the consequences did not end with the death of one child.

Four siblings were left to process a violent event that unfolded inches away from them, while their mother was forced to experience the loss in real time.

Hicks later described the pain as something only a parent who has lost a child could fully understand.

“My daughter was 5 years old,” she said. “She had so much life to live.”

Suspect Charged With Capital Murder

Harris County Sheriff Ed Gonzalez said Porter was arrested and charged with capital murder in connection with Zah’Layah’s death.

According to the report, automated license plate reader technology helped detectives develop information during the investigation and ultimately identify Porter as a suspect.

He was booked into the Harris County Jail.

Dance reported that Porter was expected to appear before a judge Monday morning, but he did not appear in the courtroom.

The reason was not entirely clear.

The judge deferred any decision on bond to the district court and also ordered a mental health assessment after describing Porter as disruptive.

Dance noted that his behavior may have been part of the reason he was not physically present for the proceeding, although that was not definitively established.

He remained scheduled for another court appearance the following morning.

Porter is presumed innocent unless and until proven guilty in court.

Questions Remain About What Led Up to the Shooting

Investigators have characterized the case as an apparent road rage shooting, but official details about a specific motive remain limited.

Dance said court documents indicate Porter told authorities he believed the other driver was a man and thought the vehicle had been driven erratically.

He also claimed he believed someone had fired at him.

Hicks, however, told FOX 26 that she had no interaction with Porter before the shooting.

That difference will likely become a major issue as the case moves through court.

For now, what is clear is that a vehicle carrying a mother and five children came under fire, a 5-year-old girl was killed, and two other children were injured by shattered glass.

The fact that this allegedly grew out of a road dispute makes the case especially disturbing, because the consequences were wildly out of proportion to whatever happened on the road beforehand.

A Family Left With Trauma and Grief

Dance said a candlelight vigil was scheduled on Grant Road in Cypress to honor Zah’Layah’s life.

For Hicks and her children, the public gathering came only days after a normal drive home turned into a deadly shooting.

The family had been only minutes from home.

Instead, they ended the night dealing with gunfire, shattered glass and the death of a child.

Hicks said she still struggles to understand why anyone would use a gun so recklessly over something that apparently happened in traffic.

That question may not be answered quickly.

The criminal case is still in its early stages, and the investigation remains active.

The Court Case Is Only Beginning

Porter now faces one of the most serious charges available under Texas law, but the judicial process is only beginning.

The judge’s decision to defer bond and order a mental health assessment added another layer to a case already marked by grief and uncertainty.

Dance reported that Porter was expected back in court for an initial appearance, while investigators continued examining what happened before the shots were fired.

For the family, however, the legal process cannot undo the central fact of the case.

Zah’Layah was 5 years old, riding home with her mother and siblings, when the vehicle was hit by gunfire.

Her mother said the last words she heard from her daughter were words of love.

That detail says more about the loss than any charging document can.

Whatever the court ultimately determines about the events leading up to the shooting, the damage to one family is already permanent, and the surviving children will have to carry the memory of that night long after the criminal case is over.
