Two Flint Township parents are facing second-degree murder, torture, and child abuse charges after the death of their 7-year-old son, Casper O’Brien, who weighed 255 pounds when he died, according to a report from ABC12’s Terry Camp.
Genesee County Prosecutor David Leyton said the case is one of the most disturbing he has seen in his years as prosecutor. He accused the parents, Damien O’Brien, 40, and Jessica O’Brien, 41, of extreme neglect that left their son severely obese, immobile, and without the medical care prosecutors say he needed.
Casper was 50.5 inches tall and weighed 255 pounds at the time of his death, Camp reported. Medical findings listed dilated cardiomyopathy, a condition involving the heart muscle, as the cause of death, with morbid obesity listed as a contributing factor.
The allegations are deeply troubling because the child was not only in medical distress, but prosecutors say his condition developed over time in a home where warning signs should have been impossible to miss.
A 911 Call Brings Police To The Home
The investigation began on Nov. 4, 2025, when a 911 call was made from the family’s Flint Township home for a child having trouble breathing.
According to Camp’s report, first responders found Casper in distress and unable to move. He was rushed to Hurley Medical Center, where he died later that night.
Leyton said the child’s condition was not the result of a sudden emergency that came without warning. Instead, he described what prosecutors believe was a long pattern of neglect involving diet, lack of medical attention, and a failure to provide a safe living environment.
“On the face of it, this is cruel and extreme suffering from this child caused by the neglect of the parents,” Leyton said.
The prosecutor said Casper had apparently been taken to a doctor only once, despite his serious health condition. That accusation sits at the center of the case, because prosecutors are arguing that the parents had the means and opportunity to seek help but failed to do so.
Prosecutors Describe Severe Neglect
Leyton told ABC12 that Casper’s diet and lack of care were part of what led to his death.
“What we allege is that he was not fed in a nutritious way,” Leyton said. “He was neglected and he was abused and his diet is part of it, and not getting whatever help he needed because he was nonverbal as part of it.”
The prosecutor said the child had been unable to move on his own. That detail makes the allegations especially serious because a child in that condition would have depended almost entirely on adults for food, hygiene, transportation, medical care, and basic daily needs.
Leyton said the available evidence points to what he called “an extreme case of child abuse resulting in someone’s death.”
Camp reported that the parents are charged with second-degree murder, torture, and multiple child abuse offenses. The charges are allegations, and the O’Briens have not been convicted.
Still, prosecutors are not treating this as a simple case of poor parenting or a medical tragedy without accountability. Leyton said he believes the alleged neglect rose to the level of willful and wanton misconduct, which is why his office pursued a murder charge.
The Weight Of A 7-Year-Old Child
The numbers in the case are hard to ignore.
Camp reported that Casper stood about 50.5 inches tall and weighed 255 pounds at the time of his death. The report noted that a healthy weight range for a 7-year-old boy of that height would generally be much lower.
Leyton said the child’s extreme obesity was linked to the heart condition that ultimately caused his death. The autopsy found dilated cardiomyopathy, a disease that can weaken the heart’s ability to pump blood.
The prosecutor said morbid obesity contributed to the fatal outcome.
There is an important difference between a child having a medical condition and a child being left without proper care while that condition worsens. The case against the parents appears to rest on prosecutors’ belief that Casper’s health crisis was preventable and that warning signs had been present for a long time.
That is what makes the allegations so painful. The child’s condition was not hidden inside a lab result or a difficult diagnosis that no one could understand. Prosecutors say it was visible, severe, and left untreated.
A Home Authorities Say Was In Disrepair
Camp also reported that police described the family’s living conditions as a hoarding situation.
Leyton said first responders found barely enough room to move through the home. The family was renting the property, and the landlord had reportedly become concerned that the house was falling into disrepair.
According to Leyton, the parents would not allow the landlord inside and instead left rent payments on the porch.
That detail may become important as the case moves through court because prosecutors could argue that the condition of the home reflected a broader pattern of isolation and neglect.
The prosecutor said Child Protective Services had never been to the residence. The children had not attended school, and no government agency or local school district appeared to know they were there.
“None of these kids even existed in the eyes of the government,” Leyton said in Camp’s report.
That statement is a harsh one, but it captures how isolated the children may have been. When a family is disconnected from doctors, schools, child welfare agencies, and neighbors, there are fewer chances for someone to notice that a child needs help.
The Family Dog Received Care
One of Leyton’s most striking comments involved the family’s dog.
He said Damien O’Brien had a good job and the family had health insurance. On the morning Casper died, Leyton said, the parents had contacted a veterinarian to arrange care for their pet.
“They had called the veterinarian about one of their pets,” Leyton said. “They knew what to do for the dog, but they didn’t do it for their own child.”
The comment was clearly meant to highlight what prosecutors see as a painful contrast: the parents allegedly knew how to seek medical help when they believed it was necessary, but did not do the same for Casper.
It is difficult to read that detail without feeling anger, but it will also likely become part of the legal case. Prosecutors may use it to argue that the O’Briens did not lack access to care, knowledge of where to go, or the ability to make a phone call when someone in the home needed help.
The defense, if one is presented, may challenge how those facts are interpreted. But Leyton’s office is already framing the contrast as evidence of deliberate neglect.
Another Child Was Also Found In Distress
The O’Briens also have a 5-year-old daughter, according to Camp’s report.
Court records cited in the report show the parents are also charged with second-degree child abuse in the presence of another child. Prosecutors allege the girl was also morbidly obese, dirty, and found naked outside by law enforcement.
She was reportedly found with knots in her hair.
The allegations involving the younger child make the case broader than Casper’s death alone. Prosecutors appear to be arguing that the home environment harmed both children and that the neglect was not limited to one medical emergency.
That is one reason the case has drawn such a strong response from local officials. It is not only about the final hours of a 7-year-old boy’s life, but about whether adults around him failed to notice or intervene long before the 911 call.
Parents Face Potential Life Sentences
If convicted, Damien and Jessica O’Brien could each face life in prison, according to Camp’s report.
Leyton said prosecutors plan to present body camera footage, autopsy findings, and evidence about Casper’s living conditions, nutrition, and lack of medical care.
“We’ll present what we think is a case of neglect and abuse and torture,” Leyton said.
The O’Briens were expected to return to court for a probable cause conference on July 2. Their attorney could not be reached for comment in Camp’s report.
Leyton said the case has been hard on prosecutors, Flint Township police, Child Protective Services, and anyone who has had to review the evidence.
“This is an extraordinarily tragic set of facts,” he said.
The case is now moving through the criminal justice system, where prosecutors will have to prove their allegations beyond a reasonable doubt. But even before a verdict, the death of Casper O’Brien has raised a painful question about how a child could become so severely ill without teachers, doctors, child welfare workers, or other adults stepping in.
Leyton’s message was simple: if someone believes a child is being abused or neglected, they should report it.
