Police in Smyrna, Georgia, are searching for a man accused of repeatedly punching and pistol-whipping a driver during a daytime road rage confrontation, while the 18-year-old woman who allegedly drove the attacker away now faces an obstruction charge after refusing to identify her passenger.
FOX 5 Atlanta reporter Denise Dillon said the violent encounter began as a traffic dispute near Cumberland Boulevard and Cobb Parkway in late June, when one vehicle reportedly cut off another and the drivers exchanged words before continuing along the road.
The situation might have ended there, but police said the driver of a black car soon realized that a silver vehicle involved in the dispute had followed him into his apartment complex, leading to another confrontation that left the man hospitalized and requiring surgery.
Investigators later identified the silver car’s driver as Hayle Kirkpatrick, but the male passenger accused of carrying out the attack remained unidentified at the time of the report.
Traffic Dispute Continued Into an Apartment Complex
Dillon reported that the two vehicles first became involved in some kind of disagreement in the middle of the day near the busy Cumberland Boulevard and Cobb Parkway area.
Words were exchanged, but both vehicles continued driving rather than stopping immediately.
According to Smyrna Police Lt. Meredith Holt, the man driving the black car eventually pulled into his residential complex and noticed that the silver vehicle was still behind him.
The victim, who is in his 50s, did not want the people in the other car to know exactly where he lived, so he stopped and walked toward the silver vehicle to speak with its passenger.
“He didn’t want the people to know where he lived,” Holt explained in Dillon’s report.
The two sides exchanged more words, and the victim began walking back toward his own vehicle.
That was when the male passenger allegedly got out of the silver car and started the physical attack.
The decision to confront someone after being followed home is understandable, particularly when a person is worried that strangers now know where he lives, but road rage encounters can become unpredictable within seconds. Once anger has carried over from the roadway into a residential area, creating distance and calling police is usually far safer than approaching the other vehicle.
Passenger Allegedly Knocked Victim to the Ground
Video released by police shows the passenger punching the victim in the face several times until he falls to the pavement.
The assault did not end once the man was on the ground.
Police said the passenger produced a firearm and used it to strike the victim, turning the confrontation into an alleged pistol-whipping.
“The driver of vehicle one was beaten pretty badly, pistol-whipped with a firearm, and he sustained significant injuries,” Holt said.
One of those injuries was serious enough to require surgery, according to police.
The footage reportedly shows the victim struggling to stand after the attackers leave. He manages to get to his feet, appears unsteady, and then collapses again.
FOX 5 anchor Russ Spencer described the video as difficult to watch, and the visible condition of the victim helps explain why investigators expect the unidentified passenger to face serious felony charges once he is found.
A gun does not have to be fired to cause life-changing damage. Used as a striking weapon, it can produce severe head and facial injuries while also creating the constant danger that it could discharge during the struggle.
Female Driver Left With the Suspect
Kirkpatrick, who was driving the silver car, got out during part of the attack, according to police.
The footage did not show her carrying out the beating, but investigators said she eventually returned to the vehicle with her passenger and drove away while the injured man remained behind.
Police identified the 18-year-old a little more than a week after the assault.
Once located, however, she allegedly refused to tell investigators the name of the man who had been riding with her.
“We have charged her with obstruction because she’s not cooperating with us on this case,” Holt told FOX 5.
Authorities issued an arrest warrant for Kirkpatrick, and police hoped that releasing her photograph might help people who knew her identify the man seen in the video.
Her refusal to provide a name has become a major obstacle because the footage apparently captured the attack but did not give detectives enough information to immediately establish the suspect’s identity.
There is a significant difference between remaining silent about an event someone merely heard about and allegedly withholding the identity of a person who committed a violent attack while riding in one’s vehicle. Investigators believe Kirkpatrick had direct knowledge that could help them locate the man.
Police Release Video to Identify the Attacker
Smyrna police released footage of the assault and an image of Kirkpatrick in the hope that members of the public would recognize the pair or remember seeing them together.
“We have released the video, and we’ve released a photo of her to see if anybody has seen them together and could possibly help us identify the male,” Holt said.
Investigators believe friends, relatives, classmates, coworkers, or others familiar with Kirkpatrick may know who was riding in her car that day.
The male suspect had not been publicly named, and police were still working to track him down.
Once identified and arrested, he is expected to face aggravated assault and aggravated battery charges.
Those charges would remain allegations until proven in court, but police said the video documents the core of the attack and shows the victim being struck repeatedly before being hit with the firearm.
Publicly releasing violent footage can be uncomfortable, particularly for the victim and his family, but investigators sometimes have few alternatives when a suspect cannot be identified through traditional records or interviews.
In this case, police appear to be relying on recognition from the community because the person who was allegedly in the best position to name the attacker has refused to do so.
An Ordinary Driving Dispute Became a Serious Felony Case
The encounter began with the kind of roadway frustration that happens every day, but police said it continued because one vehicle followed the other into a residential complex instead of allowing the disagreement to end.
By the time the victim approached the silver car, the dispute had already moved beyond an exchange between drivers and into a situation where he feared the other people might discover his home address.
The passenger’s alleged response was not limited to shouting or another brief argument. Police say he punched the victim until he fell, struck him with a gun, and then left him so badly injured that surgery was required.
The broad daylight setting makes the attack especially troubling because it occurred near homes and passing traffic, with little apparent concern about witnesses or cameras.
It also shows how quickly road rage can become detached from whatever originally caused it. Whether someone changed lanes improperly or cut off another vehicle becomes almost meaningless once a firearm is introduced and a person is lying injured on the ground.
The suspect could also pose an ongoing danger if he still has access to the weapon, which adds urgency to the effort to identify and arrest him.
Investigators Appeal for Information
Dillon reported live from Smyrna that detectives were continuing to search for the passenger and wanted information from anyone who recognized him or had seen him with Kirkpatrick.
The victim’s name was not released, and the report did not provide an update on his recovery beyond confirming that his injuries required hospital treatment and surgery.
Kirkpatrick faces an obstruction accusation for allegedly refusing to cooperate, while the passenger could face aggravated assault and aggravated battery once police establish his identity.
The investigation demonstrates how one person’s silence can slow a case even when part of the crime has been recorded. Video may show what happened, but it does not always tell police who the people are or where they went afterward.
For now, authorities have an injured victim, an identified driver who allegedly will not name her passenger, and footage of a man they say committed a brutal armed assault before escaping.
Police hope the public can provide the missing connection and identify the suspect, allowing investigators to bring the road rage case before a court rather than leaving the attacker’s identity hidden behind someone else’s refusal to cooperate.
